GENERAL TERMS AND CONDITIONS
The gift vouchers mentioned below are sold by Château de Montvillargenne, a public limited company, share capital: € 500,000, registered address: 6 avenue François Mathet, 60270 GOUVIEUX, France.1. APPLICATION AND ENFORCEABILITY OF THE GENERAL TERMS OF SALE
These general terms of sale apply to all sales of gift vouchers by Château de Montvillargenne. Any client of Château de Montvillargenne implicitly acknowledges having become acquainted with these terms of sale prior to placing their order. Therefore, the placing of an order implies the client’s full adherence to the general terms of sale of Château de Montvillargenne and his acceptance without reservations of all of their provisions. These general terms and conditions form an integral part of the contract of sale. If the client is not the beneficiary of the gift voucher, he must bring these general terms of sale to the attention of the beneficiary.2. PRICES
All prices are quoted in euros including VAT but excluding tourist tax (for information purposes, on the date of the issuing of these terms and conditions, the tourist tax amounts to € 1.50 per person and per night). The postage and packaging costs are charged additionally. The prices charged by Château de Montvillargenne may be revised at any moment in time. The only prices that are guaranteed are those that are confirmed at the time of placing the order.3. PLACING THE ORDER AND TERMS OF PAYMENT
Orders can be placed by telephone, by facsimile, by e-mail, by post or on the ‘gift ideas’ page accessible online on the www.chateaudemontvillargenne.com web site.Orders shall only be acknowledged by Château de Montvillargenne upon full payment of the price. Château de Montvillargenne accepts payment using the cards of the Carte Bleue, American Express, Visa, Eurocard / Mastercard networks, as well as cheques, bank transfers and cash, in keeping with the prevailing and applicable rules and regulations. In case of payment by cheque, payment shall only be deemed to have been made upon cashing of the cheque.
4. CANCELLATION OF THE ORDER
In principle, a request by the client for modification or cancellation of an order shall only be taken into consideration if it is sent in writing and reaches Château de Montvillargenne before the gift vouchers are sent out.As an exception to this rule, in accordance with article L. 121-20 of France’s Code de la consommation [consumer laws], if a gift voucher is bought via the www.chateaudemontvillargenne.com web site, the client shall have a timescale of 7 (seven) whole days to exercise his right to withdraw without having to provide a valid reason for this and without having to pay any penalties, with the exception of the cost of returning the goods. The abovementioned timescale shall run as of receipt of the gift vouchers by the client. The cost of returning the gift vouchers shall be borne by the client. Only gift vouchers that are returned within the abovementioned timescales may be refunded.
5. VALIDITY OF THE GIFT VOUCHERS
The gift vouchers are personal and not transferable.The gift vouchers are valid for bookings on Fridays, Saturdays or Sundays (the day being defined upon printing the gift voucher) for a period of up to 1 year as of the issue date except during the festive season.
Any gift voucher which is not used come its expiry date shall lapse and become worthless and shall not be refunded under any circumstance. Gift vouchers cannot be exchanged wholly or partly for cash.
6. BOOKING TERMS
The beneficiaries of gift vouchers must book their stays directly with the establishment prior to the expiry of the period of validity shown on the gift voucher. The serial number of the gift voucher must be quoted at the time of the booking.Beneficiaries may modify their bookings 48 hours at the latest prior to the initially agreed arrival date. No changes shall be countenanced once this deadline shall have elapsed.
In case of cancellation, the hotel must be informed by the client at least 48 hours in advance, failing which the gift voucher shall be cancelled and not reimbursed.
No deferral shall be possible without the approval of the establishment at which the booking was made and in keeping with the validity dates of the gift voucher.
7. ACCOMMODATION
The rooms are available for occupancy from 5pm on the date of arrival and must be vacated by 12pm at the latest on the departure date. Any occupation of a room after 12pm shall cause additional charges to be billed at the prevailing rate.8. COMPLAINTS
The client must notify Château de Montvillargenne of any claim regarding possible delivery errors and/or non-compliance with the order within 48 hours of delivery. Any claim that is made once this timescale shall have elapsed shall be rejected and the gift vouchers shall be deemed to be compliant with the order placed by the client.Any claim concerning the performance of the service described on the gift vouchers must be sent to Château de Montvillargenne Customer Service by recorded delivery at the address shown below within 15 days following the end of the stay.
